The Directorate for the Implementation of State Guidelines in the Field of Architecture of the Ministry of Spatial Planning, Urbanism, and State Property has annulled the conceptual design that two years ago granted approval to the Turkish company Mia Investments to build two towers of 15 and 16 floors each on the plot in front of the halls of the Adriatic Fair, returning the entire process for reconsideration.
The Directorate of the governmental department, led by Minister Janko Odović, informed the Administrative Court that it acted in accordance with the Law on Administrative Procedure regarding the administrative dispute following the lawsuit filed by the Secretariat for Property Protection of the Municipality of Budva and issued a decision annulling the decision of the Ministry of Ecology, Spatial Planning, and Urbanism dated March 18th, 2022, which granted approval to Mia Investments for the conceptual design of a hotel with apartments.
After former ministers of urbanism Ratko Mitrović and Ana Novaković Đurović found nothing unlawful in the application for the construction of the Riviera Montenegro Hotel & Residences hotel-apartment complex, two towers in front of the halls of the Adriatic Fair, the Secretariat for Property Protection appealed to the newly appointed Minister of Spatial Planning, Urbanism, and State Property Janko Odović in mid-December of last year, urging him to protect the interests of the tourism metropolis.
“We urgently request that you use your authority to protect the interests of the Municipality of Budva and make decisions based on the law regarding the construction on part of urban parcel 26.1 in block 26a within the scope of the Detailed Urban Plan (DUP) Budva center,” stated the Secretary for Property Protection of Budva Đorđe Zenović in the letter at that time.
Mia Investments, a company that brings together Turkish investors, has already begun construction work on the towers.
From the former Ministry of Ecology, Spatial Planning, and Urbanism, led by Novaković Đurović, they officially announced in July of last year that the application for construction by Mia Investments was valid.
Zenović reminded Odović that the municipal secretariat had repeatedly contacted the relevant ministry to address, as he put it, “irregularities regarding the construction application.”
Before the Administrative Court, proceedings were held to annul the decision of the Ministry of Sustainable Development and Tourism, Directorate of the Chief State Architect, dated March 18th, 2022, granting approval for the conceptual design for the construction of the facility on the mentioned plot.
Mia Investments previously provided with documents stating that the utility fee for the mixed hotel model did not exist until August 2020. Only after that was a regulation introduced for its collection. They submitted the application in May of that year, so they were not obligated.
The project approved by the Directorate of the Chief State Architect, then led by Mirko Žižić, envisaged the construction of a five-star hotel with 144 standard hotel rooms and 208 apartments for sale.
