Digital property administration improves transaction infrastructure

The Property Administration of Montenegro began electronic issuance of title and possession sheets on 10 July. Users of the eKatastar system can view documents, pay fees electronically and download legally valid, digitally signed records at any time using electronic identification. Notaries have also been given electronic access for submitting cadastral applications. 

The change should reduce transaction times and administrative costs for property purchases, mortgages, due diligence and project development. Its investment value will depend on record accuracy, resolution of historical ownership disputes and integration with municipal planning and permitting systems.

A decision by the Constitutional Court during the week reinforced the regulatory limits facing development in the UNESCO-protected area of Kotor. The court rejected five complaints concerning refused construction permits and ruled that filing a permit application does not create an acquired right to receive permission. Protection of the UNESCO-listed natural and cultural area was found to take precedence over individual construction interests. 

The ruling strengthens heritage protection but raises the importance of early planning-risk analysis for coastal investors. Land ownership and an existing application are not sufficient protection where planning rules change to satisfy Montenegro’s international conservation obligations. Development values in Kotor will increasingly depend on demonstrable planning compliance, infrastructure capacity and compatibility with heritage restrictions.

Montenegro closed CW28 with a stronger pipeline of EU and development-bank capital, a larger EPCG renewable-financing requirement and tangible progress in payments and cadastral digitalisation. Capital availability is improving, while project selection is becoming more disciplined. The principal market premium is shifting toward assets with confirmed infrastructure access, regulatory clarity and credible execution capacity.
