CAAP challenges legality of Montenegro airports tender scoring, alleging unfair evaluation favoring competitor

Luxembourg-American company Corporacion America Airports (CAAP) claims that the second scoring of the technical part of bids in the Montenegro airports concession tender was illegal, which also affected the scoring of financial offers, reports Vijesti TV.

In a letter sent on June 13 to the Tender Commission president Niko Đeljošaj, to which they never received a response, CAAP stated that the financial offer of their competitor, South Korean company Incheon International Airport Corporation (IIAC), should not have been considered because IIAC initially failed to achieve the required 80 points in the technical evaluation.

CAAP alleges that under external pressure, the Tender Commission altered the initial scoring and awarded IIAC 81.69 points.

They emphasized that the same commission members evaluated identical documents in both scoring sessions, and legally it is unacceptable for the scores to differ between two separate evaluations under the Concessions Law, which does not allow repeated or successive evaluations.

CAAP concluded that the Tender Commission, established as an independent and expert body, loses its autonomy and purpose if it cannot make decisions independently, as seen in this case.

Despite the dispute, the Tender Commission scheduled a new session and ultimately awarded the highest score to IIAC (96.18 points), while CAAP received 65.18 points. The Commission’s report deadline to the government is tomorrow.
